Thank you for your interest in our company. Data protection is a high priority for Sonnplast GmbH i.Ins. As a general principle, we do not process any personal data if you are browsing the Sonnplast GmbH i.Ins. website. However, if a you request- certain services via our website, we might be required to process certain personal data.

f)        Pseudonymisation

Recipient is a natural or legal person, public authority, agency or another body, to which the personal data are disclosed, whether or not that person is a third party. However, public authorities which may receive personal data in relation to a certain inquiry in accordance with Union or Member State law shall not be regarded as recipients.

j)        Third party

Third party is a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.

k)       Consent

4. Categories of personal data we collect

Depending on the nature of our business relationship with you or your organization, we may collect and process in particular the following categories of personal data:

  • Information collected from publicly available resources, integrity data bases and credit agencies (e.g. debtor registers, land registers, commercial and association registers, press, media, Internet, announcements);

  • Information we are legally required to collect to comply with our legal or regulatory obligations, which may include information about relevant and significant litigation or other legal proceedings against you or a third party related to you and interaction with you which may be relevant for antitrust purposes;

  • Special categories of personal data. In certain circumstances, where required by law or where you have permitted us to do so, we may collect special categories of your personal data which are specifically protected under data protection law. For example, in connection with the registration for and provision of access to an event or seminar, we may ask for information about your health for the purpose of identifying and being considerate of any disabilities or special dietary requirements you may have. 5. Purposes for which we use your personal data

Depending on the nature of our business relation, we may process your personal data for the following purposes ("Permitted Purposes"):

  • Planning, entering into, performing, managing and administering your (or a third party's to whom you are related) contractual business relationship with the Sonnplast GmbH i.Ins., e.g. by performing transactions and orders of products or services, processing payments, performing accounting, auditing, billing and collection activities, arranging shipments and deliveries, facilitating repairs and providing support services or providing you with other services or things you may have requested. The purposes of the data processing depend primarily on the concrete product. Further details regarding data processing purposes are provided in the relevant contractual documents and terms of conditions (e.g. order form, general terms and conditions, description of services, etc.);

  • Maintaining and protecting the security of our products, services and websites or other systems, preventing and detecting security threats, fraud or other criminal or malicious activities;

  • Ensuring compliance with our legal and regulatory obligations and requirements. This may include sales and business record keeping obligations for tax or other purposes and sending required notices or other disclosures, compliance screening or recording obligations (e.g. under antitrust laws, export laws, trade sanctions and embargo laws or to prevent white-collar or money laundering crimes). Where you have expressly given us your consent or otherwise legally permitted, we may process your personal data also for the following purposes:

  • Communicating with you through the channels you have approved to keep you up to date on the latest announcements, special offers and other information about products, technologies and services of Sonnplast GmbH i.Ins. (including marketing-related newsletters) as well as events and projects of Sonnplast GmbH i.Ins.;

We will only communicate with you for advertising purposes (e.g. by e-mail and telephone calls) if you have given us your express consent in advance, as far as required by law. You may opt out at any time if you do not want to receive any further marketing-related types of communication from us. We apply modern technology to monitor and analyse data in relation to our products (also known as Internet of Things). Such information is used to support our customers, e.g. by improving our product design and enhancing product service. Typically, no personal data is processed in connection with any such technologies. Where that is the case, personal data will be processed strictly in line with this Data Privacy statement and in accordance with applicable law. We will not use your personal data for taking any automated decisions affecting you or creating profiles other than described above. An exclusive automated decision is a decision based on automated processing in which no natural person is involved. Should we use this procedure in individual cases, we will inform you of this separately if this is required by law.

The website of the Sonnplast GmbH i.Ins. collects a series of data and information when a data subject or automated system calls up the website. This data and information are stored in the server log files. We process your personal data in general only in the European Economic Area. The Sonnplast GmbH i.Ins. is a globally active company. The data controller process and store the personal data of the data subject only as long as necessary to achieve the purpose of storage, or if permitted by the European legislator or other legislators in laws or regulations to which the controller is subject to.

If the storage purpose is not applicable, or if a storage period prescribed by the European legislator or another competent legislator expires, the personal data are routinely blocked or erased in accordance with legal requirements.

 

15. Rights of the data subject

Under certain conditions established by law, you may request access to your personal data, their correction or deletion (right to be forgotten) or the restriction of their processing. You may also object to the processing (this also applies to profiling based on this provision as defined in Article 4 No.4 GDPR) or exercise your right to data transfer. In particular you have the right to request a copy of the personal data that we hold about you. If you make this request repeatedly, we may make an adequate charge for this. Please refer to Articles 15-22 of the GDPR for details on your data protection rights.

If you have given us your consent for the processing of your personal data, you may withdraw your consent at any time with future effect, i.e. the withdrawal of the consent does not affect the lawfulness of processing based on the consent before its withdrawal. If you withdraw your consent, we will only continue processing your personal information where there is another legal ground or where we are legally required to do so.

For any of the above requests, please send a description of your personal data concerned by stating your name and appropriate proof of identity (e.g. your customer number) to the contact details below. We may require additional proof of identity to protect your personal data against unauthorized access. We will carefully consider your request and may discuss with you how it can best be fulfilled.

If you have any concerns about how your personal data is handled by us or wish to raise a complaint on how we have handled your personal data, you can contact us at the contact details below to have the matter investigated. If you are not satisfied with our response or believe we are processing your personal data not in accordance with the law you can complain to the competent data protection supervisory authority in your country.

If you file an objection, we will no longer process your personal data unless we can prove compelling reasons for the processing worthy of protection which outweigh your interests, rights and freedoms, or the processing serves the assertion, exercise or defence of legal claims.

In individual cases we process your personal data in order to operate direct advertising. You have the right to object at any time to the processing of your personal data for the purpose of such advertising; if you object to the processing for the purpose of direct advertising, we will no longer process your personal data for these purposes. 16. Data protection for applicant and during the application procedure

The data controller collects and processes the personal data of applicants for the purpose of the processing of the application procedure. The processing may also be carried out electronically. This is the case, in particular, if an applicant submits corresponding application documents by e-mail or via a web form on the website to the controller. If the data controller enters into an employment agreement with an applicant, the submitted data will be stored for the purpose of processing the employment relationship in compliance with legal requirements. If no employment agreement is concluded between the applicant and the controller, the application documents will be automatically erased two months after notification of the decision, provided that no other legitimate interests of the controller are opposed to the erasure. Other legitimate interest in this relation is, e.g. a burden of proof in a procedure under the General Equal Treatment Act (AGG).

 

17. Legal basis for the processing

Art. 6(1) lit. a GDPR is the legal basis for processing activities for which we obtain consent. If the processing of personal data is necessary for the performance of a contract to which the data subject is party, for example, when processing operations are necessary for the supply of goods or to provide any other service, the processing is based on Article 6(1) lit. b GDPR. The same applies to such processing operations which are necessary for carrying out pre-contractual measures, for example in the case of inquiries concerning our products or services. Is our company subject to a legal obligation by which processing of personal data is required, such as for the fulfillment of tax obligations, the processing is based on Art. 6(1) lit. c GDPR. In rare cases, the processing of personal data may be necessary to protect the vital interests of the data subject or of another natural person. This would be the case, for example, if a visitor were injured in our company and his name, age, health insurance data or other vital information would have to be passed on to a doctor, hospital or other third party. Then the processing would be based on Art. 6(1) lit. d GDPR. Ultimately, processing operations could be based on Article 6(1) lit. f GDPR. This legal basis is used for processing operations which are not covered by any of the abovementioned legal grounds, if processing is necessary for the purposes of the legitimate interests pursued by our company or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data. Such processing operations are particularly permissible because they have been specifically mentioned by the European legislator. The European legislator considered that a legitimate interest could be assumed if the data subject is a client of the controller (Recital 47 Sentence 2 GDPR).

 

18. The legitimate interests pursued by the controller or by a third party

Where the processing of personal data is based on Article 6(1) lit. f GDPR our legitimate interest is to carry out our business in favor of the well-being of all our employees and the shareholders.

 

19. Period for which the personal data will be stored

The criteria used to determine the period of storage of personal data is the respective statutory retention period. After expiration of that period, the corresponding data is routinely deleted, as long as it is no longer necessary for the fulfillment of the contract or the initiation of a contract.

 

20. Provision of personal data as statutory or contractual requirement; Requirement necessary to enter into a contract; Obligation of the data subject to provide the personal data; possible consequences of failure to provide such data

We clarify that the provision of personal data is partly required by law (e.g. tax regulations) or can also result from contractual provisions (e.g. information on the contractual partner). Sometimes it may be necessary to conclude a contract that the data subject provides us with personal data, which must subsequently be processed by us. The data subject is, for example, obliged to provide us with personal data when our company signs a contract with him or her. The non-provision of the personal data would have the consequence that the contract with the data subject could not be concluded. Before personal data is provided by the data subject, the data subject must contact any employee. The employee clarifies to the data subject whether the provision of the personal data is required by law or contract or is necessary for the conclusion of the contract, whether there is an obligation to provide the personal data and the consequences of non-provision of the personal data.

 

21. What if I'm under 16?

If you are under 16, please make sure that you obtain your parent/guardian’s permission prior to providing us with any of your personal data. Persons under the age of 16 are not permitted to provide us with their personal data without such consent.

 

22. Changes to this notice

This Data Privacy Notice was last updated in March 2019. From time to time, we may make change or amend it as required to reflect any changes to the way in which we use your personal data or changing legal requirements. So you may wish to check back from time to time or whenever you make available personal data to us. Any amended Data Privacy Notice will apply from the date it is posted on our website.
